🚤 MarinAssistant - Terms of Use (EULA)

This End User License Agreement ("Agreement") is a binding legal contract between you ("User") and MarinAssistant ("Company"). By installing or using the App, you agree to these terms.

1. Description of Service

MarinAssistant is a boat management application providing:

• Boat Profile & Fleet Management: Manage multiple boats with detailed specifications, photos, and documents
• Maintenance Tracking: Track maintenance tasks, service history, and receive reminders
• AI-Powered Assistant: Get answers to boat-related questions using AI technology
• Voyage Tracking: Record your trips with GPS tracking and voyage logs
• Anchor Watch: Monitor your boat's position and receive alerts if it drifts
• Community Features: Connect with other boaters through posts, groups, events, and messaging
• Academy: Access educational content about boating
• Weather & Maps: View weather forecasts and nautical chart information

2. Subscription Terms (Auto-Renewable)

• Payment: Charged to your iTunes/Play Store Account at confirmation of purchase
• Auto-Renewal: Subscription automatically renews unless turned off at least 24 hours before the end of the current period
• Management: You can manage and cancel subscriptions in your device's Account Settings
• Free Trials: Any unused portion of a free trial will be forfeited when you purchase a subscription
• Refunds: Refund requests are handled by Apple/Google according to their respective policies

3. User Accounts

• You must be at least 13 years old to use this app
• You are responsible for maintaining the confidentiality of your account credentials
• One person per account; sharing accounts is not permitted
• You can delete your account at any time via Settings → Account → Delete Account

4. User Generated Content (Zero Tolerance Policy)

• Ownership: You retain ownership of content you post
• License: By posting, you grant us a license to display your content within the app
• Prohibited Content: Hate speech, nudity, harassment, spam, illegal content, copyright infringement
• Moderation: We monitor reported content and remove violations within 24 hours
• Bans: Users violating these policies will be permanently banned from community features
• Reporting: Report offensive content via the flag icon on posts/profiles

5. AI Assistant

• AI responses are generated using third-party AI services (Cerebras)
• AI insights are provided "AS IS" and may not always be accurate
• Do not rely solely on AI for critical safety decisions
• AI conversations may be used to improve the service (anonymized and aggregated)

6. Location Services

• Anchor Watch and Voyage Tracking require location access
• Location is collected only when these features are active
• Background location is used for Anchor Watch to alert you if your boat drifts
• You can disable location access anytime in your device settings

7. Disclaimer of Liability

• The App and all features are provided "AS IS" without warranties of any kind
• We do not guarantee the accuracy of weather data, maintenance predictions, or AI insights
• You are solely responsible for the physical maintenance and safety of your vessel
• We are not liable for any direct, indirect, incidental, or consequential damages arising from use of the app
• Navigation information is for reference only; always use official nautical charts

8. Intellectual Property

All rights to the App, including code, design, user interface, trademarks, logos, and databases, are owned by MarinAssistant. You may not copy, modify, distribute, or reverse engineer any part of the application.

9. Termination

• We may terminate or suspend your account for violations of these terms
• You may delete your account at any time via Settings → Account → Delete Account
• Upon termination, your data will be permanently deleted as described in our Privacy Policy

10. Changes to Terms

We may update these terms from time to time. We will notify you of significant changes via in-app notification or email. Continued use of the app after changes constitutes acceptance of the new terms.

11. Governing Law

This Agreement is governed by the laws of the Republic of Turkey. Istanbul Courts have exclusive jurisdiction for any disputes arising from this agreement.
